These terms are a legal agreement between you and Emre Karaduman (“we”, “us”), the individual developer of the E-commerce Billionaire game (the “Game”). By downloading or playing the Game you agree to them. If you don’t agree, please don’t use the Game.
Our Privacy Policy explains how we handle data and forms part of these terms.
1. Licence
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the Game on Apple-branded devices you own or control, for your own non-commercial entertainment, in line with these terms and the App Store usage rules. The Game is licensed, not sold. We reserve all rights not expressly granted.
2. Who can play
The Game is intended for a general audience but is not directed at children under 13. If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian, who accepts these terms on your behalf and is responsible for any purchases.
3. Virtual currency and items
The Game contains virtual currencies (such as in-game money and gems), shares, boosts and other virtual items (“Virtual Items”). You acknowledge that:
- Virtual Items are licensed to you as part of the Game licence; you do not own them and they have no monetary or cash value.
- Virtual Items cannot be exchanged for real money, goods or services from us or anyone else, and cannot be sold, traded, gifted or transferred to another person or device, except through features we provide in the Game.
- We may manage, adjust, rebalance or remove Virtual Items (for example to fix bugs or balance the economy). We will not remove Virtual Items you paid for with real money except where they were obtained through a bug, exploit or fraud, or where the Game is discontinued as described in section 8.
- Because your progress is stored on your device and there is no account, we cannot restore Virtual Items lost by deleting the Game, resetting your device or losing your device. Non-consumable purchases can be restored as described below.
4. In-app purchases and refunds
- Purchases are made through Apple’s App Store and are subject to Apple’s terms and payment methods. Prices are shown in the Game in your local currency, including any taxes Apple applies.
- Consumable purchases (e.g. gem packs) are delivered immediately and used up in the Game. Non-consumable purchases (e.g. a permanent pack) can be restored on devices using the same Apple ID via Settings → Restore purchases.
- All purchases are final and non-refundable, except as required by applicable law or granted through Apple’s refund process. We cannot issue refunds ourselves; please request one at reportaproblem.apple.com.
- If you are a consumer in the EU/EEA, UK or Türkiye, you agree that digital content is supplied immediately after purchase and you acknowledge that you therefore lose your right of withdrawal once delivery begins, to the extent permitted by law.
- If a purchase is refunded or charged back, we may remove the related Virtual Items.
5. Rewarded ads
The Game offers optional rewarded ads. You choose whether to watch; rewards are granted after the ad completes. Ads are provided by third parties (Google AdMob) and we are not responsible for their content. Rewards may be limited per day and are not guaranteed if an ad fails to load.
6. Acceptable use
You agree not to:
- cheat, use bots, exploits, modified clients or tools that tamper with the Game, its save data, purchases or ad rewards;
- copy, modify, decompile, reverse-engineer or create derivative works of the Game, except where the law expressly allows it;
- use the Game for any unlawful, commercial or fraudulent purpose, or enter offensive, infringing or unlawful content (for example as your store name);
- interfere with the Game’s servers, services or other players, or circumvent security or technical limits.
7. Intellectual property
The Game and all its content — code, graphics, characters, music, sounds, text and the “E-commerce Billionaire” name and logo — are owned by us or our licensors and protected by copyright, trademark and other laws. Product names, brands and places in the Game are fictional; any resemblance to real companies is coincidental.
8. Updates and availability
We may update, change or remove features, content or Virtual Items, and some updates may be required to keep playing. We try to keep the Game available but do not guarantee it will always work without interruption. We may stop offering or supporting the Game; if we do, we will give reasonable notice in the Game where possible.
9. Termination
You may stop using the Game at any time by deleting it. We may suspend or end your licence if you materially breach these terms (for example by cheating or fraud). On termination, your licence and any Virtual Items end, and sections 3, 7 and 10–14 continue to apply.
10. Disclaimers
To the maximum extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will be error-free, secure or uninterrupted, or that save data will never be lost. Nothing in these terms limits your statutory rights as a consumer.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or Virtual Items. Our total liability for any claim relating to the Game is limited to the amount you paid us for the Game in the 12 months before the claim, or USD 50 if greater. These limits do not apply to liability that cannot be limited by law, such as liability for intent, gross negligence, or death or personal injury caused by negligence.
12. Apple-specific terms
If you downloaded the Game from Apple’s App Store:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the Game and its content.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the Game.
- We, not Apple, are responsible for handling any claims relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the Game infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as “terrorist supporting”, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example your mobile carrier’s) when using the Game.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules. The courts and enforcement offices of Istanbul (Central) have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence or of your right to bring a claim before the consumer arbitration committees or courts where you live. Please contact us first — most issues can be solved quickly by e-mail.
14. Changes to these terms
We may update these terms from time to time. We will change the effective date above and, for material changes, notify you in the Game. Continuing to play after changes take effect means you accept them. If any provision is found unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Game.
